Advocate Prashant Bhushan, representing the NGO Centre for Public Interest Litigation, emphasized that the government should provide incentives to encourage consumers to transition to electric-powered vehicles, acknowledging that EVs are currently more expensive than fossil fuel vehicles. He also advocated for the government to lead by example by completely shifting its own fleet to electric.

Justice Surya Kant, heading the bench, noted that five years have passed since NEMMP 2020 was formulated, indicating a need for policy revision. The Attorney-General R. Venkataramani, representing the Centre, stated that a complete shift to electric vehicles is a significant policy decision. The court’s observations highlight a judicial push for stronger governmental action on EV promotion as a measure against vehicular pollution.
